Some services are supplied directly by us. Other services are supplied using third-party networks, carriers, wholesale providers, platforms, suppliers or service partners.
Availability, pricing, tariffs, data allowances, speeds, coverage, service features and service terms may vary depending on the product, supplier, network, destination, location, device, customer requirements and any applicable customer agreement.
3. Website terms and customer agreements
These Terms and Conditions apply to your use of our website, including browsing the website, submitting enquiries, requesting quotes, requesting availability checks and accessing general information about our services.
These Terms and Conditions do not, by themselves, create a contract for the supply of telecoms, mobile, IoT, M2M, eSIM, VoIP, broadband, cloud software, business energy procurement or related services.
Where you place an order or enter into a customer-specific agreement with Data SIM Direct Ltd, the supply of those services will be governed by the relevant quote, proposal, Order Form, Business Customer Agreement, Service Schedule, customer contract, invoice, tariff guide, acceptable use policy, fair use policy or other service-specific terms provided to you.
If there is any conflict between these website Terms and Conditions and a signed customer agreement, Order Form, Service Schedule or customer-specific contract, the signed customer agreement, Order Form, Service Schedule or customer-specific contract will take priority.

You may use this website for lawful purposes only.

6. Quotes, availability and orders
Submitting an enquiry, quote request, availability check or contact form through this website does not create a contract between you and Data SIM Direct Ltd.
Any prices, savings, tariffs, roaming charges, data allowances, coverage statements, availability information or service descriptions shown on the website are for general guidance only unless confirmed by Data SIM Direct Ltd in writing as part of a specific quote, proposal, Order Form, invoice or customer agreement.
A contract is only formed when Data SIM Direct Ltd accepts your order in writing, starts providing the relevant service, issues a confirmed order, or both parties sign or accept the relevant customer agreement, Order Form, proposal or service-specific contract.
All services are subject to:

network or wholesale provider acceptance;

credit approval where applicable;

technical compatibility;

stock availability;

payment setup;

successful provisioning;

customer identity, authority or business checks where required;

We reserve the right to decline any enquiry, quote request or order at our discretion.
7. Business customers
Most Data SIM Direct services are intended for business customers.
Where you are a business customer, you confirm that you are acting for business purposes and that you have authority to submit enquiries, request quotes, provide business information and, where applicable, place orders on behalf of the relevant business or organisation.
Our website content is not intended to include all contract terms that apply to business services. Business services are normally supplied under a separate customer agreement, Order Form, Service Schedule, written proposal or invoice.
Business services may be subject to minimum terms, notice periods, early termination charges, supplier terms, network terms, acceptable use policies, fair use policies, payment terms, credit limits, usage controls, roaming terms and cancellation provisions.
8. Consumer customers
Some services, such as travel data eSIMs, may be available to individual consumers.
Where you purchase as a consumer, your statutory rights are not affected. We will provide any legally required pre-contract information before you are bound by a purchase.
For digital products or services that are delivered immediately, such as eSIM QR codes, activation details or downloadable service information, you may be asked to confirm that you want immediate delivery and that you understand this may affect your right to cancel once the digital product or service has been supplied.
9. Travel data eSIMs
Travel data eSIMs are subject to availability, destination coverage, device compatibility, network availability and the terms of the relevant eSIM supplier, network operator or roaming partner.
Before ordering a travel data eSIM, you are responsible for checking that:

your device supports eSIM;
-
your device is unlocked;
-
your device is compatible with the relevant eSIM service;
-
the destination and package selected are suitable for your travel needs;
-
you have provided accurate email and contact details;
-
you follow the activation and installation instructions correctly.
Unless stated otherwise, travel eSIMs are data-only and do not include a UK mobile number, standard voice calls or standard SMS.
Coverage, speed and performance may vary depending on the destination, local network, signal strength, device, congestion, roaming partner and other factors outside our control.
Once an eSIM QR code, activation code or profile has been issued, it may not be possible to cancel, reuse, replace or refund it
unless the issue is caused by a fault for which we or our supplier are responsible, or unless your statutory rights require otherwise.
10. SIM cards, eSIMs and connectivity services
Physical SIM cards, eSIM profiles and connectivity services are subject to network provisioning, supplier systems, technical checks and the customer information provided being correct.
You must not use our SIMs, eSIMs or connectivity services for unlawful, abusive, fraudulent or prohibited purposes. This includes, but is not limited to:

sending spam or nuisance communications;
-
fraud, scams or artificially inflated traffic;
-
unlawful monitoring, tracking or interception;
-
bulk SMS, automated dialling or telemarketing unless expressly agreed and legally compliant;
-
SIM box, GSM gateway or traffic pumping activity;
-
use that damages, overloads or harms any network or system;
-
resale, redistribution or shared commercial access without written permission;
-
use in sanctions-restricted countries, sectors or applications where prohibited;
-
use that breaches any supplier, network, acceptable use or fair use policy.
We may suspend, restrict, refuse or terminate services where misuse, non-payment, fraud, security risk, abnormal usage, supplier restriction or breach of contract is suspected.
11. Network coverage and service availability
Mobile, IoT, roaming, VoIP, data and connectivity services depend on third-party networks, platforms, suppliers and infrastructure.
We cannot guarantee that services will be uninterrupted, fault-free, secure from all unauthorised access or available in every location.
Service may be affected by:

signal strength;
-
building materials;
-
local geography;
-
network congestion;
-
maintenance;
-
outages;
-
roaming partner availability;
-
supplier or carrier issues;
-
local regulation;
-
device settings;
-
device compatibility;
-
customer equipment;
-
power or broadband failure;

software updates;

customer configuration.
Coverage maps, speed estimates and availability checks are indicative only and do not guarantee actual performance.
You remain responsible for deciding whether the services are suitable for your intended use, locations, resilience needs, device setup and business requirements.
12. IoT, M2M and data-only services
IoT, M2M and data-only services may include SIMs, eSIMs, multi-network connectivity, roaming connectivity, pooled data, fixed IP, private APN, VPN, L2TP, remote device connectivity, routers, telemetry, CCTV, backup broadband or similar services.
These services are subject to supplier acceptance, technical compatibility, device behaviour, country availability, roaming partner availability, local regulation and lawful use in the deployment country.
You are responsible for ensuring that any device used with the service is lawful, secure, correctly configured, technically compatible and suitable for use on the relevant network.
Multi-network or roaming SIMs do not guarantee access to every network in every location. Network access may change, be restricted or be withdrawn due to roaming partner, supplier, local operator, regulatory, technical or commercial reasons.
Unless we expressly agree in writing, IoT and M2M services must not be used as the sole connectivity method for life-critical systems, emergency systems, medical systems, alarm signalling, payment terminals, safety equipment, lifts, fire systems, transport control, industrial control or any use where failure could cause death, personal injury, property damage or substantial loss.
You should maintain suitable backup connectivity, security controls and business continuity arrangements where connectivity is important to your business.
13. Roaming and international use
Roaming and international services are subject to destination, tariff, supplier rules, roaming partner availability, fair use policies, delayed billing and local restrictions.
Roaming destinations, country groupings, availability and charges may change due to supplier, network, regulatory or roaming partner changes.
Roaming, international, premium-rate, satellite, maritime, aviation and third-party charges may be reported late and billed in arrears.
Spend caps, usage alerts, roaming alerts, data bars and similar controls are designed to reduce risk but may not prevent all additional charges in real time.
You are responsible for checking roaming requirements, destination charges and device settings before travel or international deployment.
14. VoIP and cloud phone services
Cloud-based phone and VoIP services rely on broadband, power, customer equipment, third-party platforms and internet connectivity.
You are responsible for ensuring that your broadband connection, router, firewall, handsets, internal network, power supply and device settings are suitable for the service.
Emergency calling may not operate in the same way as a traditional fixed telephone line, especially during power cuts, broadband outages, equipment failure or service disruption.
You should ensure you have alternative arrangements where emergency access, business continuity or resilience is business critical.
15. Business energy procurement services
Where we provide business energy procurement support, we act as an introducer, consultant or intermediary and not as an energy supplier.
Energy prices, contract availability and supplier terms may change quickly. Any quote or recommendation is subject to supplier acceptance, credit checks, contract terms and market conditions at the time of acceptance.
You are responsible for reviewing any supplier contract before signing.
We are not responsible for a supplier’s service performance, billing accuracy, contract decisions, meter issues, network issues, supply interruptions or energy supply obligations.
16. Prices and VAT
Unless stated otherwise, business prices are shown excluding VAT.
Consumer-facing prices will be shown inclusive of VAT where required.
Prices may change due to supplier increases, network changes, tariff changes, exchange rates, taxes, regulatory costs, roaming charges, platform charges or other costs outside our control.
Any confirmed recurring charges, usage charges, out-of-bundle charges, roaming charges, one-off fees, delivery fees, provisioning charges, equipment charges or administration charges will be set out in the relevant quote, invoice, Order Form, proposal or customer agreement.
17. Payment and billing
Payment terms will be confirmed in the relevant invoice, Order Form, mandate, proposal, agreement or contract.
We may use payment methods including Direct Debit, GoCardless, card payment, bank transfer or other approved payment methods.
Unless we agree otherwise in writing, services may not be activated, provisioned, dispatched or continued until any required payment setup, mandate, upfront payment, deposit or first invoice payment has been completed.
If payment is late, fails or is cancelled, we may:

suspend or restrict services;
-
charge reasonable administration, bank, supplier or reconnection costs;
-
require payment in advance;
-
require a security deposit;
-
require another approved payment method;
-
recover outstanding sums;
-
terminate services where non-payment continues.
You remain responsible for all valid charges incurred on your account, including line rental, service charges, usage, roaming, out-of-bundle usage, premium charges, supplier charges and any other agreed fees.
18. Customer responsibilities
You agree to provide accurate and complete information when contacting us, requesting a quote or placing an order.
You are responsible for:

checking that services meet your requirements before ordering;
-
ensuring devices and equipment are compatible;
-
ensuring users comply with applicable terms and policies;
-
keeping account, billing and contact details up to date;
-
keeping SIMs, eSIM QR codes, devices, portals and passwords secure;
-
monitoring usage where applicable;
-
paying all agreed charges on time;
-
notifying us promptly of suspected faults, loss, theft, misuse, abnormal usage or unauthorised use;
-
ensuring services are used lawfully and not in breach of supplier or network rules.
19. Cancellations, returns and refunds
Cancellation rights depend on the type of customer, the service purchased, the order method and any service-specific agreement.
Business customers may be subject to minimum terms, notice periods, early termination charges, supplier cancellation rules, provisioning charges, equipment charges or other charges set out in the relevant quote, Order Form, invoice or customer agreement.
Consumer customers may have statutory cancellation rights when purchasing online or at a distance, unless an exemption applies or the service has been supplied with the required consent.
Digital services, including eSIM QR codes, activation codes and digital profiles, may not be refundable once supplied, activated, downloaded, installed or used, unless faulty or otherwise required by law.
Physical SIM cards or equipment must be returned unused and in the condition supplied where a return is accepted. You may be responsible for return postage unless the item is faulty or we have agreed otherwise.
Refunds, where due, will usually be made to the original payment method.
20. Faults, support and complaints
If you experience a fault or service issue, you should contact us using the details shown on this website or in your customer agreement.
We will make reasonable efforts to investigate and progress support requests, but we may need to refer matters to third-party networks, suppliers, carriers or platform providers.
We do not control third-party networks, suppliers, engineers, systems, timescales or decisions.
We are not responsible for faults caused by customer equipment, device settings, local coverage, third-party outages, incorrect installation, unauthorised changes, misuse, damage, lack of access, no fault found or failure to follow instructions.

Where a separate customer agreement, Order Form or service-specific contract applies, any liability provisions in that agreement will take priority for the relevant services.
26. Events outside our control
We are not responsible for delay or failure to perform our obligations where caused by events outside our reasonable control.
This may include network outages, supplier failures, power failures, cyber incidents, natural events, regulatory changes, industrial action, war, terrorism, government action, pandemics, major infrastructure failure or supply chain disruption.
